Terms and Conditions for the PaysafeCard Players Pass

1.     General Provisions

1.1.   Please read these Terms and Conditions ("T&Cs") carefully as they set out important information about your rights and obligations in relation to the use of your PaysafeCard Players Pass ("PaysafeCard Players Pass") and you are obliged to use your PaysafeCard Players Pass in accordance with these T&Cs.

1.2.   Your PaysafeCard Players Pass is issued and administered by Paysafe Prepaid Services Limited ("PSC" or "we" or "us"), whose registered office is at 70 Sir John Rogerson's Quay, Dublin 2, D02 R296, Ireland (registration number: 626671).

1.3.   We perform our services under a licence to issue electronic money issued in Ireland and are regulated under the European Communities (Electronic Money) Regulations 2011 by the Central Bank of Ireland (CBI) from which we have been authorised (CBI registration number C185005). We are entitled to offer our services on a cross-border basis in Germany on the basis of the regulations on the EU passport.

1.4.   By purchasing or using a PaysafeCard Players Pass, you agree to the validity of these Terms and Conditions, which constitute the contract between you and us.

1.5.   The current version of the T&Cs is made available for download on the PSC www.paysafecard.com website ("website") under the "T&Cs" link.

 

2.     Fees

We do not charge any fees for verifying your balance and information on the website. Otherwise, the following fees apply to the use of the PaysafeCard Players Pass:

  • Redemption: For the redemption within the meaning of Section 5 of the T&Cs, the amount of €7.50 per PaysafeCard Players Pass PIN will be deducted directly from the amount to be paid out as part of the redemption.
  • Monthly fee: FREE for the first 30 (thirty) days from the purchase of your PaysafeCard Players Pass and €3 per month after the 30 (thirty) days have passed. The amount will be deducted directly from your PaysafeCard Players Pass balance.
  • Conversion fee: Fee in accordance with clause 7.

 

3.     Acquiring a PaysafeCard Players Pass

3.1.   The PaysafeCard Players Pass can be purchased from authorised distributors ("distribution outlets") against payment of the nominal value. An overview of the locations of authorised distribution outlets can be found on the website. The PaysafeCard Players Pass may only be purchased via the Internet through authorised online shops listed on the website .

3.2.   The PaysafeCard Players Pass can only be purchased at a distribution outlet if you pay the value printed on the PaysafeCard Players Pass.

3.3.   The limit of PaysafeCard Players Passes that can be purchased at a point of sale at any given time is published on the website.

3.4   Each PaysafeCard Players Pass is allocated a PIN (Personal Identification Number). If you purchase a PaysafeCard Players Pass locally, the authorised distribution outlet will give you the PaysafeCard Players Pass in the form of a paper printout , which contains the PIN and serial number of your PaysafeCard Players Pass, among other things. If the distribution outlet is an authorised online shop, you will receive your PIN in electronic form. As electronic data can be stolen or destroyed, you should print out the PIN and serial number of your PaysafeCard Players Pass and keep it safe .

3.5.   When purchasing the PaysafeCard Players Pass, you will need to check that it includes a PIN and serial number. If you cannot read the PIN or if you believe that your PaysafeCard Players Pass has been tampered with in any way, please inform us by quoting the serial number of the PaysafeCard Players Pass (a description of the contact details can be found on our website). To receive a replacement, you must provide us with a copy of the PaysafeCard Players Pass (the serial number must be visible on it). After a positive review of the facts, a replacement is possible.

3.6.   You are prohibited from transferring your PaysafeCard Players Pass to a third party for a fee. It is prohibited to trade, acquire or sell PaysafeCard Players Pass PINs through unauthorised distribution outlets. This prohibition explicitly refers to so-called "exchange platforms", where PaysafeCard Players Pass PINs are offered for sale illegally. PSC reserves the right to block or prevent the use of PaysafeCard Players Pass PINs that have not been acquired legally or prevent the use of credit of this kind acquired for payment purposes .

 

4.     Use of the PaysafeCard Players Pass

4.1.   You can use the PaysafeCard Players Pass to pay at PaysafeCard contract companies ("online shops") to the extent of the existing e-money amount. The conditions for the acceptance of PaysafeCard payments listed on the website of the respective online shop apply. To use the PaysafeCard Players Pass, you need access to an Internet-enabled computer, whereby JavaScript must be activated in the browser.

4.2.   By purchasing a PaysafeCard Players Pass, you acknowledge that the PaysafeCard Players Pass may only be used in authorised online shops in the gaming sector.

4.3.   If you are a registered customer ("myPaysafe account"), the PaysafeCard Players Pass can also be used to top up your myPaysafe account. If you use the PaysafeCard Players Pass to top up your myPaysafe account, the relevant terms and conditions of the myPaysafe account will apply.

4.4.   When paying with your PaysafeCard Players Pass, you will be asked to enter your PaysafeCard Players Pass PIN. By entering the PaysafeCard Players Pass PIN, you irrevocably authorise the immediate debiting of the payment amount for the respective product or service from your PaysafeCard Players Pass. At the same time, you irrevocably authorise us to arrange for this debit to be carried out and for the money to be transferred to the online shop.

4.5.   The customer expressly agrees that PSC may access, process and store all data necessary to provide the payment service. This is without prejudice to the mutual rights and obligations of the customer and PSC with regard to the Data Protection Act. The customer can revoke the consent by cancelling the PaysafeCard Players Pass. If the customer withdraws their consent in this way, PSC will no longer use the customer data for the stated purposes; however, this does not affect PSC's right to process the data for other legal reasons, such as if PSC is legally obliged to document transactions.

4.6.   All debits are made in euro (€). In the case of payments for goods and services in other currencies, the amount to be paid shall be converted in accordance with clause 7.

4.7.   You can use the PaysafeCard Players Pass for payments until the balance on the PaysafeCard Players Pass is used up.

4.8.   For the same payment process ("transaction") you can use several PaysafeCard Players Pass PINs. You can find the maximum payment amount on the website.

4.9.   It is not possible to purchase vouchers via the voucher shop operated by paysafecard.com Wertkarten Vertriebs GmbH with PaysafeCard Players Pass PINs. These vouchers can only be purchased via the myPaysafe account.

4.10.  You can view the balance of your PaysafeCard Players Pass ("balance query") as well as the transactions carried out with the PaysafeCard Players pass ("transaction overview") at any time on the website by entering the PaysafeCard Players Pass PIN .

Note: Due to anti-money laundering regulations and to minimise risk, prior registration or customer identification may be required when purchasing and using the PaysafeCard Players Pass.

 

5.     Your right of redemption

5.1.   You are entitled to request the redemption of the amount of e-money on your PaysafeCard Players Pass at any time. You can contact us for this purpose using the contact options on the website . In order to arrange for the redemption of the amount on your PaysafeCard Players Pass, you must provide us with the serial number of the PaysafeCard Players Pass in question, the remaining balance on your PaysafeCard Players Pass, your full first and last name, your email address and telephone number, a legible copy of your photo ID, a legible copy of your PaysafeCard Players Pass and your personal bank account within Germany including IBAN and BIC, to which we should transfer the amount. In order for us to comply with our legal obligations, we may ask you for certain other information before we can process your redemption request. It is not possible to withdraw the amount of e-money on your PaysafeCard Players Pass in cash.

5.2.   There is no minimum amount for the redemption of e-money, but the amount of e-money on the PaysafeCard Players Pass must be sufficient to cover the fees incurred in connection with the specific redemption. For a redemption during the current term of the contract as well as a redemption more than 1 (one) year after the end of the contract, the fees mentioned under clause 2 will be charged.

5.3.   In the event of a redemption, PSC will arrange for the transfer of the amount chosen by the customer, minus the applicable fees, to a bank account named by the customer within Germany. In order to comply with the law, PSC is entitled and obliged to ask the customer to confirm their identity before the redemption request can be successfully processed. The customer agrees that PSC may verify his/her identity as part of the redemption process prior to payment of the redemption amount in order to prevent the risk of fraud and to comply with anti-money laundering guidelines and other legal requirements.

5.4.   The redemption of PaysafeCard Players Pass PINs issued to the customer as part of a promotion/advertising campaign is excluded unless these amounts are e-money .

 

6.     Term of contract and cancellation

6.1.   The contract between you and us is concluded for an indefinite term. For technical reasons, it may be the case that a validity date is printed on your PaysafeCard Players Pass. However, this does not have any impact on the term of the contract, or the value stored on the PaysafeCard Players Pass.

6.2.   According to these T&Cs, you have the right to cancel your PaysafeCard Players Pass at any time during the contract term and also to have the relevant credit paid out in accordance with clause 5. If you have purchased your PaysafeCard Players Pass as part of distance selling using only means of distance communication (e.g. online, at a vending machine or similar), you have the right to withdraw from the contract within 14 (fourteen) days from date of purchase free of charge.

6.3.   If you cancel, we will block the PaysafeCard Players Pass so that it can no longer be used. You cannot demand a refund of an amount that you have already used for a good or service up to the time of the blocking.

6.4.   Upon cancellation, we will ensure the redemption of all unused e-money amounts on your PaysafeCard Players Pass, provided that you have provided us with the information and documents required in accordance with clause 5 and that all transactions and the fees incurred have been debited and the total amount of the PaysafeCard Players Pass has not been uploaded to a myPaysafe account in accordance with clause 4.3.

6.5.   We are entitled to immediately block a PaysafeCard Players Pass or terminate the contract if we suspect fraud or abuse or other security concerns or if we are legally obliged to do so. This applies in particular, if there is a  suspicion that you have purchased PaysafeCard Players Pass PINs from exchange platforms or the like, whether for a fee or free of charge. If these security concerns are resolved, we will issue you with a replacement PaysafeCard Players Pass with the value of the blocked PaysafeCard Players Pass upon request. If the value of the newly issued PaysafeCard Players Pass is higher than the balance on the defective PaysafeCard Players Pass, you will have to pay us the difference.

6.6.   This agreement shall also be deemed to be terminated with immediate effect by you if you use the entire balance of your PaysafeCard Players Pass to top up your myPaysafe Account in accordance with clause 4.3. The provision of Section 8 of these T&Cs shall remain unaffected by this and shall also apply after termination of the agreement.

Note: The T&Cs provisions, which entitle us to charge a redemption fee after termination of the contract, shall also apply after termination of this contract.

 

7.     Currency

7.1.   The PaysafeCard Players Pass PINs are issued in euro (€). All debits from your PaysafeCard Players Pass are made in euro.

7.2.   Any payments made in a currency other than euro will be converted into euro by us at the exchange rate in effect at the time the transaction is carried out. Our applicable exchange rates are available at any time on the website. The exchange rate used and the amount deducted from the PaysafeCard Players Pass will also be displayed when the payment process is completed.

7.3.   For each payment transaction in a currency other than the currency of your PaysafeCard Players Pass we apply a conversion surcharge. This amounts to 3% of the transaction volume.

 

8.      Your duties of care and conduct in the event of abuse

8.1.   You are required to keep your PaysafeCard Players Pass secure and to protect your PIN against unauthorised use by third parties. In your own interest, do not share your PIN with any third party.

8.2.   Think of your PaysafeCard Players Pass like cash. If you lose your PaysafeCard Players Pass, it will not be replaced. Please note that if lost or stolen, you may lose some or all of the balance on the PaysafeCard Players Pass . PSC will not be able to replace or refund you in the event of loss or make the cards unreadable.

8.3.   In order to prevent misuse by spying on your PIN via the Internet, you must make sure before entering your PIN that it is the PSC payment window under the website with the URL customer.cc.at.paysafecard.com and that the PaysafeCard security certificate is visible in the address bar of the browser.

8.4.   If you become aware of the loss or theft of your PaysafeCard Players Pass, misuse or other unauthorised use of your PaysafeCard Players Pass, you must inform us immediately (a description of the contact details can be found on the website, so that the amount remaining on the PaysafeCard Players Pass can be blocked immediately ("blocking notice"). The same applies if you suspect that another person has gained unauthorised knowledge of your PIN, misuse or other unauthorised use of your PaysafeCard Players Pass. In order to be able to block a PaysafeCard Players Pass, the serial number must be provided. You must also report any abuse to the police immediately.

8.5.   Once the block has taken place, unless you have fraudulently initiated the blocking, you can request the issuance of a replacement PaysafeCard Players Pass for the remaining value of the blocked PaysafeCard Players Pass. Before we issue a new PaysafeCard Players Pass, you must provide us with proof of the purchase of the stolen/misused PaysafeCard Players Pass. In the event of theft of a PaysafeCard Players Pass, you must also provide us with the relevant file number of the relevant police station. A replacement of the amount of e-money used up to the blocking notice is excluded.

Note: PSC staff will never ask you to disclose your PaysafeCard Players Pass PIN to us or any third party by phone, email or any other means. PaysafeCard Players Pass PINs can only be entered directly on the website and via the PSC payment window. If you have any doubts about the authenticity of the website, please contact our customer service using the contact details on the website.

 

9.     Enquiries/complaints

9.1.   For all enquiries regarding the use of your PaysafeCard Players Pass and/or if you are in any way dissatisfied with your PaysafeCard Players Pass or with the way we design our service, please let us know by email at info@paysafecard.com , so that we can investigate the facts for you. Any of your complaints will be dealt with promptly and appropriately. In order to be able to identify your report as a complaint as quickly as possible, please explicitly refer to your request as a "complaint".

9.2.   For unresolved complaints, you can also contact the Irish Financial Services and Pensions Ombudsman, whose registered office is at Lincoln House, Lincoln Place, Dublin 2, Ireland, by telephone (+353 1 567 7000 [note: international telephone rates apply]) or by email (info@fspo.ie).

9.3.   Furthermore, the out-of-court appeal procedure pursuant to Section 14 of the Injunction Act is available.

 

10.  Liability of PSC

10.1.   PSC's liability is limited to intent and gross negligence. In the event of a breach of duties, compliance with which is important for the achievement of the purpose of the contract ("essential contractual obligations"), we shall also be liable for slight negligence, limited to the foreseeable damage typical of the contract. Any liability of PSC is limited to direct damages. Insofar as PSC's liability is excluded, limited or restricted, this also applies to the personal liability of PSC's employees, workers, staff, representatives and vicarious agents.

10.2.   On the basis of Section 10.1, PSC assumes no liability for unforeseeable damages. Further, PSC accepts no liability for damages caused by acts of God, civil unrest, war, natural disasters or other events beyond reasonable control.

10.3.   The uninterrupted availability of the PaysafeCard system is not guaranteed. We will inform you in good time on the website about foreseeable technical maintenance work that impairs or prevents the usability of the PaysafeCard system. You cannot derive any claims against us from the temporary unavailability of the PaysafeCard system.

10.4.   We do not accept any responsibility or liability for the quality, safety, legality or any other aspect of the goods and/or services paid for through the PaysafeCard Players Pass. Disputes regarding transactions paid for via the PaysafeCard system must be settled directly with the contracting company.

10.5.   You are obliged to notify us of any damage immediately. We are entitled to request information from you about damages that are or may be relevant against the background of the above-mentioned liability regulations in order to ensure that we have the necessary information as early as possible to be able to take measures to mitigate the damage.

10.6.   In the event that you do not use your PaysafeCard Players Pass in accordance with these Terms and Conditions, or we discover that you are fraudulently using the PaysafeCard Players Pass, we reserve the right to charge you for any reasonable costs we incur in order to take steps to prevent you from continuing to use this PaysafeCard Players Pass. We also reserve the right to claim compensation against you for any sums of money we are required to raise as a result of your actions.

10.7.   The above exclusions, limitations and restrictions of liability do not apply to claims under the Product Liability Act or to damages resulting from injury to life, limb or health.

10.8.   You acknowledge that your PaysafeCard Players Pass is not subject to the Irish Deposit Guarantee Scheme.

 

11.  Data protection

12.  Change to the T&Cs

12.1.   It is agreed that we may make changes to these T&Cs from time to time, for example if required to do so by law, to clarify information or for other business reasons that we deem necessary. If one or more changes are required, we will give you 2 (two) months' notice, stating the reasons for the changes and their impact on the contractual relationship between you and us. All notices and changes will be posted on the website. You should check the website periodically for any such changes.

12.2.   You have the right to cancel this agreement with immediate effect prior to the effective date of the change. If you do not object to the changes in writing before the proposed date of entry into force of the change, the changes will be deemed to have been accepted and become an effective part of our contract. In the announcement of the change to the contract, PSC will once again draw your attention to the consequences of your silence and to your right to terminate the contract free of charge and without notice.

12.3.   If you object to the changes, they will not apply to you. However, such objection shall constitute a termination of these T&Cs by you. For further information, we refer to clause 5. (Redemption) and clause 6. (Cancellation). In this case, you will not be charged a redemption fee.

12.4.   The mere extension of functionality, the introduction of new services or the change of payment methods and contracting companies does not have the effect of changing the agreement.

 

13.  Transfer of the contractual relationship

13.1.   We are entitled to transfer rights and obligations arising from the contract with you to another company at any time, whereby we will notify you of this at least 2 (two) months in advance on the website. Your rights will not be impaired in this case.

13.2.   If you do not agree to the transfer, you are entitled to cancel the contract with immediate effect free of charge until the transfer takes effect. For further information, we refer to clause 5. (Redemption) and clause 6. (Cancellation). The customer is not entitled to transfer rights and obligations under these T&Cs to third parties.

 

14.  Notices

14.1.   Communication with you and notices to you will be in German. You can also choose one of the other languages we support that are available for your request. Documents or communications in languages other than German are for convenience only and do not oblige us to communicate further in that language.

14.2.   The contract language is German.

 

15.  Severability clause

Insofar as individual clauses or parts of individual clauses should be invalid, this shall not affect the validity of the rest of the contract.

 

16.  Applicable law and jurisdiction

16.1.   This contract is governed by the laws of the Federal Republic of Germany with the exception of the banking supervisory rules, which are governed by Irish law in accordance with the country of origin principle.

16.2.   Any disputes arising from this contractual relationship shall be subject to the jurisdiction of the courts in Germany.
